Wills
A Will is a must have for everybody. The tales of woe arising from a person dying intestate are endless – family stress and conflict, missed opportunities to avoid tax etc. Recording who are to be guardians will be important for those with children, whilst Wills can give married and civil partners the potential to avoid all 40% inheritance tax. All couples who own a property can use their Wills to provide the optimum protection of their home, e.g. from long term care costs and the implications of the survivor entering a new relationship or incurring debts.

Deeds of Variation
These allow beneficiaries of a deceased's estate, whether there is a Will or not, to vary the settlement where it does not meet their own best interests. For example, the settlement may not optimise inheritance tax avoidance or exposes assets unnecessarily to long term care costs or omits someone who was expected to be a beneficiary. A Deed of Variation must be submitted to the Probate Registry within 2 years of the death. Deeds of Variation can be complex and require a solicitor to complete the process. Tony will take you through all aspects and ensure matters are bespoke to your requirements.
Lasting Powers of Attorney
These grant to others of your choice the authority to administer your personal finances or make decisions about your health and welfare when you are not able to do so. It is very expensive and invariably a long and tortuous process for anyone to obtain the same authority after a loved one has lost their mental capacity. Not surprisingly this can be the source of considerable family stress. An accident or illness can strike at any time so Lasting Powers of Attorney are not just for the elderly.

Where no one has been given authority, the Court of Protection will appoint a 'deputy', usually a solicitor, to manage the affairs of a incapacitated person at great expense to their estate.
Probate
This legal process applies at the time of death of most of us. Whilst DIY can be an option, not everyone wishes to take on the responsibility, has the time to give or has the necessary competence when an estate or legal matters are complicated.
